Legality...If you take a picture of a musician in a concert can you publish it?

I go to a lot of concerts and I love to take pictures at the events. I literally have hundreds of photos of different celebrities. Can I publish them? Can I use them? Or upload them in social media? WITHOUT getting each musicians permission to use them?

And what about selling them to different publications?

No it doesn't. The person's level of stupidity or obnoxiousness does not constitute a determining factor in any case. In fact, without a proper release, no commercial vendor would go as far as even consider it.

What I mean is in a less obtuse manner is, if you can get their permission; try asking.

When you sell it, the license has to expressly be for editorial use only. You may sell it and use it but not for any commercial purposes.

Depends on the country you're in, but generally, you can only sell them for news related stuff, not for personal use.
Most musicians don't mind if you post them on social media and such, since they consider it free publicity, although you always have that odd ball who bitches about it, like Lady Gaga for example.

You probably can't use them for profit unless you sell them through some kind of publishing agency. It's pretty much how a journalist or pap probably does it.

Fair use allows you to sell them for news related use such as online blogs, newspapers, and other publications. You can't sell the for commercial use such as in an advertisement, product brochure or on packaging.
